TERMS & CONDITIONS

The parties of this Agreement are ("The User") and Langbury Pty Ltd as trustee trading as The Will Registry ("The Will Registry") collectively known as ("the parties"). The terms and conditions which constitute this Agreement will be subject to periodic amendment which will be posted on this website ("the Website"). Such amendments will constitute acceptance by the parties of the amended terms and conditions.

Covenants

The User and The Will Registry agree as follows:

The User

(a) will be responsible for the data which is registered on the database of the Website ("the Data") and in particular in relation to its accuracy and completeness.

(b) will be responsible for the update of the Data relating to all documents as a result of changes to the documents or their location.

(c) will comply with the terms of the privacy policy as contained on the Website.

(d) will not use the Website in any way which is:
a. unauthorised;
b. negatively effects the function of the Website, or;
c. is in any way inconsistent with these terms and conditions.

(e) will use the Website and the services provided by The Will Registry only in accordance with these terms and conditions.

(f) will only become a User if it is a person aged 18 years or older.

(g) will, in the event that the User is a professional, obtain the consent of its client for the registration of its Data on the Website.

(h) guarantees the accuracy of information which it provides to conduct a search of the Data.

(i) will not use The Will Registry in a manner which may cause loss or damage directly or indirectly to any other party. The User indemnifies The Will Registry from all liability for loss and damage of whatsoever nature and wheresoever occurring which may result directly or indirectly from its use of the Website.

(j) will request the written consent of The Will Registry for any party which requests a link to this Website. In the event that such a link is approved (with such conditions as deemed required by The Will Registry) then The Will Registry shall not be considered to operate in any business relationship or partnership with those other parties appearing on such links.

(k) agrees that all Data registered on the Website shall be available for public search at such fees as set by the Will Registry.

The Will Registry

(a) does not make any warranties in relation to the accuracy of Data recorded on the Website. This remains the responsibility of The User.

(b) will provide a fully secure facility for payment of all transactions.

(c) will provide a receipt for the registration of documents via a confirmation email together with a receipt for payment.

(d) may deny access to the Website for any user without prior notice or reason.

(e) will not provide refunds in any manner whatsoever.

(f) will not be liable under contract ,tort or breach of statute for any loss and /or damage, direct or consequential, which may arise from the use of the Website by the User.

Severability

In the event that any of these terms and conditions is held to be invalid or unenforceable, this will not affect the balance of the remaining terms and conditions and their force at law.

Governing Law

These terms and conditions shall be construed in accordance with the laws of Queensland Australia.
